Welcome to Daavilefx! These Terms of Service (“ToS” or “Terms”) govern your use of our website (daavilefx.com), products (e.g., Expert Advisor, EA), and services (e.g., copy trading, PAMM, custom coding).
By accessing our website, purchasing our products, or using our services, you agree to these Terms.
Please read them carefully, as they form a binding agreement between you and Daavilefx (operated by Ernesto).
1. Acceptance of Terms
By using Daavilefx, you confirm that:
- You are at least 18 years old (our services are not intended for individuals under 18).
- You have the legal capacity to enter into this agreement.
- You agree to comply with these Terms and all applicable laws and regulations, including GDPR, CCPA, and local financial regulations for forex trading.
If you do not agree, please do not use our website, products, or services.
2. Description of Services
Daavilefx provides trading tools and services for forex markets (primarily XAU/USD) to users worldwide who can invest through regulated brokers. Our offerings include:
- Expert Advisor (EA): A one-time purchase of a digital trading system (program, code, or software) designed for unlimited use across your accounts, which you own permanently upon purchase. The EA began development in 2019 and testing in 2021, using past real tick-data, pre-tested exclusively with developers, with all available funds at risk, funded solely by developer investment, after discounting costs of developing and sustaining the algo running 24/7. After multiple rounds of testing and positive results, I (Ernesto) reinvested thousands of hours and resources into developing new versions, culminating in Version 3, with numerous fixes and modifications to the original versions. We continue to reinvest in both the brand and system, aiming for the perfect balance of risk:reward, with plans for even greater enhancements. Once purchased, the EA is yours to use as you wish—automatically with our investing strategies, in hybrid mode for trading, as an indicator with demo accounts, or as a testing tool in the Strategy Tester. We cannot reclaim or take the EA away, but you may not resell it; however, you can profit as a service provider from strategies you create, not ours. Lifetime updates are included to ensure the system remains at its best risk:reward factor possible with available data, delivering value to anyone who follows simple risk management rules and our guidelines. The knowledge and value gained from using the EA, even just in the Strategy Tester, far exceed its price, offering an extraordinary value-to-reward ratio.
- Copy Trading (Copy FX): Available in free or premium options. The free version offers a 50/50 profit split with a minimum requirement of $250 USD, managed directly on the broker’s platform (Daavilefx never controls client funds). Premium services offer better profit splits for clients, an upfront fee, and additional perks detailed in your contract. You can disconnect from Copy FX at any point via the broker’s platform.
- PAMM-MM (Money Management) Services: Premium-only services providing mm through regulated brokers as intermediaries (Daavilefx does not handle your funds directly). Higher split based on performance, with an upfront fee and perks outlined in your contract. You can disconnect from PAMM-MM at any point via the broker’s platform.
- Custom Coding: We deliver the tool (e.g., MT4/MT5 EAs or strategies) at a price negotiated with you, using Whop Commerce as the payment processor. We provide the code, source code, and a signed agreement (e.g., “Custom Coding Agreement”), which you own. We also offer a final meeting before coding to ensure clarity, documenting all requirements. If additional changes are needed after the initial plan, they must be agreed upon in writing and signed. Forward testing is a separate service not included here.
- Backtesting Services: We deliver a backtested, forward testing and demo-tested EA over a specified period, analyzing different market moves, with full reports and a presentation in Figma (if paid). We continue backtesting, forward testing and optimizing with new data as long as you support VPS costs and our fee. If you choose not to continue, we stop optimization, but the EA remains yours with prior updates.
All transactions are processed securely through Whop Commerce, subject to their terms and policies.
3. User Conduct
You agree to use Daavilefx responsibly and lawfully.
Prohibited activities include:
- Misusing or reverse-engineering the EA or any digital products.
- Sharing, distributing, or selling our intellectual property (e.g., EA code, strategies) without permission.
- Engaging in fraudulent, abusive, or illegal activities, including manipulating trading systems or breaching broker terms.
- Using our services for purposes other than personal forex trading or investment through regulated brokers.
- Harassing our support team (via email, Discord, or call/video call) or disrupting our community.
We reserve the right to suspend or terminate access for violations, with or without notice, but we cannot reclaim the EA—only ban you from our communities if you violate terms.
4. Payment and Transactions
- Expert Advisor (EA): Sold as a one-time payment via Whop Commerce. Daavilefx does not offer refunds for the EA, as outlined in our Disclaimer and Refund Policy. By purchasing, you acknowledge that outcomes depend on your actions, market conditions, adherence to our rules, and the time you invest in learning and using the system effectively. You waive any right to refunds, understanding that the EA’s value—tested with five years of verified positive results and ongoing improvements—benefits both you and our community (see H2: 6. Refunds). Before purchasing, you must sign an acknowledgment agreeing to our no-refund policy, protecting both you and Daavilefx from misunderstandings or misuse.
- Copy Trading (Copy FX):
- Free Version: A 50/50 profit split with a minimum requirement of $250 USD, managed via the broker’s platform. No upfront fees, but you can disconnect at any time.
- Premium Version: Offers better profit splits for clients, an upfront fee, and additional perks detailed in your contract, managed via the broker’s platform. You can disconnect at any time.
- PAMM-MM (Money Management) Services: Premium-only, with an upfront fee, profit splits favoring clients, and perks outlined in your contract, managed via the broker’s platform. You can disconnect at any time. Daavilefx never controls client funds.
- Custom Coding: Priced as negotiated, processed via Whop Commerce. We deliver the code, source code, and a signed “Custom Coding Agreement,” which you own, along with backtesting reports and a Figma presentation (if paid). A final meeting ensures clarity before coding, with changes documented and signed.
- Backtesting Services: Priced as agreed, processed via Whop Commerce. We deliver backtested and demo-tested EAs with reports, requiring your support for VPS costs and our fee to continue optimization with new data.
- Third-Party Terms: All transactions are subject to Whop Commerce’s terms and policies, including payment processing and dispute resolution for transactions (not product/service outcomes).
5. Intellectual Property
All content on Daavilefx, including the EA, strategies, blog posts, and code, is the intellectual property of Ernesto unless otherwise stated.
Visuals may include resources from the internet or AI-generated images, credited where applicable.
You may not reproduce, distribute, or modify our materials without permission, except for personal use of purchased products/services as intended.
Once purchased, the EA and coding deliverables are yours permanently (you cannot resell them, but you can profit from strategies you create, not ours).
6. Refunds
Daavilefx does not offer refunds for digital products, including the Expert Advisor (EA), custom coding, or backtesting services, as they are one-time purchases or project-based deliverables.
The EA’s value depends on your commitment, market conditions, and adherence to our strategies, offering potential for significant returns based on five years of verified positive results and ongoing enhancements.
If you request a refund, we lose not only our investment but also a system that, with proper use, can generate income for you over time.
For custom coding, we complete based on your outlined requirements, with a final meeting ensuring clarity—changes after the initial plan must be documented and signed, and we take responsibility only for what’s agreed upon in writing.
For backtesting, we do our best to deliver quality reports and demo-tested EAs, but we cannot guarantee results or “make magic” if EA is not proper for markets.
Our 1 time payment fee prevents toxic behavior, trolls, or misuse, ensuring funds sustain new EA versions, better servers, and innovative strategies, while building a thriving community.
By agreeing to these Terms, I (Ernesto) am glad to work together to grow Daavilefx and the value we provide—if this policy doesn’t align with your needs, there are other solutions or developers you can explore before taking this step.
Transaction-related issues (e.g., payment disputes) are handled by Whop Commerce, per their policies.
7. Disclaimer and Risks
Our products and services are provided “as is” without warranties.
Forex trading involves substantial risk, and you may lose some or all of your capital.
We do not guarantee profits, results, or financial success (see our Disclaimer for full details).
The EA system began development in 2019 and testing in 2021, always funded with developer own money and all available capital at risk at the time.
After investing in code and running the algo 24/7, only time could determine the outcome.
Following positive results, I (Ernesto) reinvested thousands of hours in developing new versions, with the end goal of maintaining the algo at its best risk:reward factor possible using available data.
Lifetime updates are included to ensure the system remains optimized, delivering value to anyone who follows simple risk management rules and our guidelines.
Use our tools and services at your own risk, and consult a licensed financial advisor before trading.
8. Limitation of Liability
Daavilefx, Ernesto, and affiliates are not liable for any direct, indirect, incidental, or consequential damages arising from your use of our website, products, or services.
This includes, but is not limited to, financial losses, data loss, or third-party disputes.
Our liability is limited to the extent of providing what is paid for with up front risk:reward clarity.
9. Dispute Resolution
If a dispute arises, you agree to:

- Use good-faith negotiations to resolve issues, including via Discord or call/video call support for premium clients.
- If unresolved, disputes will be settled through binding arbitration under Mexican law (or applicable local law for non-Mexican users), conducted in English or Spanish, with jurisdiction in Mexico City, unless otherwise required by law.
- Transaction-related disputes (e.g., payment issues) may be subject to Whop Commerce’s dispute resolution processes.
For custom coding, we recommend first contacting us directly; if unresolved, we will proceed with Whop’s dispute system.
10. Termination
We may terminate or suspend your access to Daavilefx’s products or services at any time for violations of these Terms, without refund (except as required by law).
We cannot reclaim the EA or coding deliverables once sold, but we can ban you from our communities (e.g., Discord) if you violate terms.
You may terminate your use by discontinuing access, but no refunds are available for digital products or services.
11. Changes to These Terms
We may update these Terms periodically to reflect changes in our practices or legal requirements.
The “Last Updated” date at the top indicates the latest version.
We’ll notify you of significant changes via email, our website, or Discord.
By continuing to use Daavilefx after updates, you agree to the revised Terms.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of Mexico, unless otherwise required by applicable local laws for users outside Mexico.
Any legal actions will be resolved in Mexico City, subject to arbitration as outlined in H2: 9. Dispute Resolution.
