Daavile FX Service Contract
This Service Contract (“Contract”) is entered into between Daavile FX, hereinafter referred to as the “Provider,” and the individual or entity, hereinafter referred to as the “Client,” as of the date of purchase through Whop. This agreement governs the provision of Daavile FX digital trading products, including the Expert Advisor (EA), Copy FX (social trading), and PAMM (Percentage Allocation Management Module) services, designed for use on platforms like MT4/MT5.
Services Offered
The Provider offers digital trading products, including the Daavile FX System, an Expert Advisor (EA) coded in MQL4/MQL5, operating on MT4/MT5 platforms, and capable of trading various financial assets in live, demo, and backtesting environments. These products include:
- Daavile FX System: A comprehensive trading system designed to enhance your strategies on MT4/MT5, included as our core service offering.
- Copy FX (Social Trading): A service allowing the Client to automatically mirror the Provider’s trades in real time using regulated brokers as intermediaries.
- PAMM (Percentage Allocation Management Module): A service pooling Client funds under the Provider’s management, with profits split based on pre-set ratios, offered exclusively through VT Markets.
All services utilize the Provider’s Daavile FX System, personal strategies, and active management, delivered through Whop and executed via regulated brokers (RoboForex, Vanguard, VT Markets, TeleTrade) to clients worldwide.
Sales Conditions
- Payment Structure: The Client agrees to a one-time payment for the Daavile FX System, Copy FX, or PAMM services via Whop, with no additional subscriptions required unless specified for premium services. Whop handles all payments, deposits, and withdrawals, charging a 5% transaction fee, and the Provider does not manage or touch Client funds directly.
- No Refunds: All purchases are final and non-refundable due to instant digital access. If the Client faces issues with Whop (e.g., payment delays, processing errors), they may request a refund by emailing support@daavile.com with the subject “WHOP REFUND + YOUR NAME,” including their name, email, and Whop username. The Provider will review disputes quickly to release funds if Whop is at fault, but no refunds are issued post-access. After purchase, the Client receives a reminder of this policy, locking in no refunds or returns.
Support Included: Support is provided for the duration of the service, including real-time assistance via Discord (included with purchase), email (support@daavile.com), social media (Daavilefx), Telegram (
), or scheduled calls/videos for premium clients.
Investment Risks and Performance
- The Client acknowledges that trading and investing involve inherent risks, and past results do not guarantee future outcomes. The Provider cannot promise future profits or protect against losses, especially in high-risk accounts (e.g., cents, standard, or those with less than $25,000 USD in margin/buying power).
- The Provider aims to surpass inflation and the S&P 500 on a yearly basis, adjusted for available margin risk, but this is an estimate based on past data and real trading results since 2021, showing the system can profit. Success is not guaranteed, and the Provider is not responsible for losses. Risk is managed under all available deposit in worst-case scenarios (not daily, like during extreme events like COVID), unless the Client pays for premium risk management services.
Intellectual Property
- The EA, strategies, and all related digital products are the exclusive creation and property of Daavile FX. The Client must not sell, crack, redistribute, share, or modify the EA or strategies without prior written authorization from the Provider.
- The Client may use any strategy derived from the EA for personal benefit or services (e.g., consulting), provided the EA remains protected, owned by the Client, and not shared or resold.
Product Protection and Usage
- Each copy of the EA includes encrypted information, such as the Client’s name, client number, and technical details, enabling identification if redistributed or cracked. This protects the Provider against unauthorized use.
- The Client may use the EA on unlimited MT4/MT5 accounts but must not place it on a VPS not owned by them, send it to others, or share it, as this constitutes resale or distribution, violating this Contract. Unauthorized use results in immediate loss of server access, future updates, support, and potential legal action.
- The Provider uses regulated brokers (RoboForex, Vanguard, VT Markets, TeleTrade) as intermediaries, never directly controlling or managing Client funds. All trading occurs in the Provider’s account for Copy FX or pooled PAMM accounts, benefiting primarily from profits as a top trader, not Client capital.
Free Portfolio and Premium Services
- Free Portfolio (Copy FX and PAMM): Clients can start with a free portfolio requiring a $250 USD minimum deposit in their broker account (cents or non-cents, < $25,000 USD margin). Copy FX trades can be connected or disconnected anytime, while PAMM joins funds under management, splitting profits 50/50 with the Provider when profitable, delivering solid value.
- Premium Services: For better profit splits (e.g., higher Client share), the Provider offers premium management, requiring additional payment. Risk management remains under deposit unless upgraded, but splits favor the Client more.
Legal Actions and Dispute Resolution
- If the Provider detects unauthorized distribution, cracking, or misuse of the EA, legal action will be taken based on the distributor’s place of residence, including seeking damages and injunctions to protect intellectual property.
- The Client agrees not to dispute charges with Whop unless there’s a proven failure by the Provider (e.g., non-delivery of EA, Copy FX, or PAMM access). Disputes (e.g., chargebacks) without valid cause violate this Contract, risking loss of access, support, and legal action. All payment disputes must be addressed with Whop or the selected broker, not the Provider.
Delivery and Support
- After agreeing and purchasing through Whop, the Client gains access to Copy FX or PAMM via their broker account. The EA is delivered via Telegram or Discord—provide your ID in Whop or email support@daavile.com with “WHOP MISSING QUESTIONS + YOUR NAME” if needed. For strategies, submit your risk profile in Whop; for custom setups ($2,000+), email “EA TAILORED RISK SETFILES + YOUR NAME.” Note: Google may flag the EA as a virus or limit email delivery, so Telegram/Discord is preferred.

Governing Law and Jurisdiction
This Contract is governed by the laws of Mexico.
Any disputes arising from this agreement will be resolved through arbitration in the Mexico City, or in a court of competent jurisdiction if arbitration fails, at the Provider’s discretion.
Entire Agreement
This Contract constitutes the entire agreement between Daavile FX and the Client, superseding all prior agreements or understandings.
Amendments require written consent from both parties.
Acceptance and Signature Requirement
By purchasing through Whop and checking the agreement box on daavile.com or Whop, the Client agrees to these terms.
