Terms of Service
Important: This agreement covers two separate offerings: 1) monthly subscription access, and 2) money-management services. Each has different payment, refund, and termination rules. Read both sections before paying.
1. Acceptance of Terms
By accessing DAAVILE ALGO TRADING private channels, software, apps, algorithms, or management services, you agree to these Terms. If you do not agree, you must not purchase or use the service.
2. Payment Methods
DAAVILE ALGO TRADING uses the following payment structure:
- Monthly Subscription (Whop): recurring subscription through Whop for community/tool access.
- Money Management & Premium Access (Whop or Crypto): yearly management/service fees can be paid via Whop or direct cryptocurrency.
- Verification: access is granted after payment confirmation and required agreement acceptance.
3. Monthly Subscription Terms (Whop)
The monthly subscription provides access to the private community, tools, algorithms, and related materials. It does not include money-management services unless explicitly stated.
- Recurring Payments: billing continues until you cancel through Whop.
- Cancellation: it is a monthly subscription — you may cancel at any time through Whop; after cancellation, no further charges are applied.
- Termination for Cause: violation of community rules or the environment may result in a ban/removal. No refunds for the current billing period.
- Ban & Payments: a banned member simply stops paying — no further charges occur, because Whop handles the subscription. No refunds for the period already paid.
4. Money Management Terms
Money management services involve deploying strategies on your behalf through regulated brokers. These services are distinctly different from the monthly subscription.
- Fee Structure: the yearly fee covers VPS hosting + my management services, both paid for the space of 1 year.
- No Refunds: money management is non-refundable. The fee covers VPS + services reserved for the full year.
- Step Down: if the client steps down early, the fee stays — the year was reserved and paid for regardless of when the client leaves.
- Risk Crossing the Line: if, in the worst case scenario, risk crosses the line, the user must understand that risk and opportunity come both ways.
- Risk Acknowledgement: clients must sign an agreement confirming they know the risks and are not investing money they cannot afford to lose.
5. Model Selection & Risk Responsibility
Clients decide how they participate. This choice affects risk profile and must be accepted in writing before deployment.
- Baseline Model: default participation follows the optimized model based on the 2004–present full-spectre period (current and past results).
- Risk %: clients choose what % of risk to run based on capital invested.
- Aggressive Models: clients may choose more aggressive models by reducing the model spectre (2004–present). Reduced spectre = higher risk.
- Extra Clause: if a client chooses a shorter or specific period besides the full spectre, they sign another clause accepting the extra higher risk.
- Non-Guarantee: results shown are historical/backtest reference material. I cannot be responsible for future market conditions — clients get what they see in my models, current and past results.
What clients receive:
Clients get access to the models, configurations, backtests, and forward data available at the time of engagement. Future market conditions may differ materially from past results. We are not gambling; we are investing in high-volatility assets where reward and risk come every day.
6. Refunds & Adjustments
Refunds are not the default. They are considered only under narrow conditions.
- Monthly Subscription: no refunds once access has been granted; future billing can be cancelled (stop paying, no further charges).
- Money Management: no refunds — the fee covers VPS + services for 1 year.
- Exception Path: if a refund is considered and the reason is accepted, any refund may be reduced by transaction costs, processing fees, and third-party platform charges. The user is responsible for those costs and may not receive the full amount paid.
7. Agreements & Contracts
Before access or management release, users may be required to sign or otherwise accept pre-release terms, risk acknowledgements, and model-selection clauses. If the user does not accept those terms, access may be refused or refunded only under the limited exception path above.
8. Educational & Risk Disclosure
All content, signals, algorithms, and tools are for informational and educational purposes. No content constitutes regulated financial advice. You are the executor of your own capital and broker relationship.
9. Intellectual Property
All software, apps, algorithms, configurations, and methodologies remain the property of DAAVILE ALGO TRADING unless explicitly transferred in writing. Redistribution, resale, reverse engineering, or public sharing is prohibited.
10. Limitation of Liability
To the maximum extent permitted by law, DAAVILE ALGO TRADING is not liable for losses arising from market movement, broker execution, internet/VPS failure, misuse of tools, or reliance on historical results.
